Required Terms


The following link provides you with a copy of the Contractual Provisions Attachment (KU-146a) - (PDF) form that contains terms and conditions required in all State contracts. Sending a copy of the KU-146a to the contractor for review early on in the process, for example, when you first acquire a copy of the contractor's terms and conditions, will prevent delays. Making this form part of the agreement will often alleviate specific terms and conditions in an agreement, which otherwise may have to be modified or deleted.

The Contractual Provisions Attachment (KU-146a) - (PDF) must be incorporated into a contractor's terms and conditions by attaching it to the agreement AND typing the following language (found in quotations at the top of the KU-146a) onto the face of the agreement: "The provisions found in Contractual Provisions Attachment form KU-146a (Rev. 5-14), which is attached hereto, are hereby incorporated in this contract and made a part hereof." An authorized representative of each party to the agreement must initial the typed-on language on the agreement.
